This Privacy Policy is part of the Terms and Conditions governing this website and should be read in conjunction therewith. This Privacy Policy applies to activities we engage in on our websites, mobile phone applications (including mini programs and official accounts), and activities that are offline or unrelated to our websites, as applicable (collectively “our services”).

By using our services and agreeing this Privacy Policy you authorize us and grant your express consent to us:

  • to collect, use, store, process, transfer and/or disclose and to treat automatically or mechanically any data provided by you (including without limitation, data considered personal, private, sensitive or confidential) in connection with the operation of our services;

Who decides why and how we process your Personal Data?

We determine why and how we process your Personal Data and we are responsible for your Personal Data.

 

What Personal Data might we collect about you?

  1. Personal Data 
    Personal Data refers to all kinds of information related to identified or identifiable natural persons recorded by electronic or other means, excluding the information processed anonymously (“Personal Data”). The meaning of Personal Data may differ in different jurisdictions according to applicable laws and regulations. 

We collect different types of Personal Data for different reasons – this may include:

  • Identity Data includes first name, maiden name, last name, username or similar identifier, marital status, title, date of birth and gender.
  • Contact Data includes billing address, delivery address, email address and telephone numbers.
  • Financial Data includes bank account, payment card details and coupons information.
  • Transaction Data includes data necessary for us to process payments and implement fraud prevention measures, including credit / debit card numbers, security code numbers and other such relevant billing details.
  • Personal Location Data includes tracking information, accommodation information, etc.
  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, open ID, union ID and your online actions, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.   • Profile Data includes your username and password for platforms maintained by the ICR (where you have access to any), purchases or orders made by you, your interests, preferences, feedback and survey responses.   The main purposes of collecting profile data are for personalization and customization of service, account management, analytics, and audit. 
  • Marketing and Communications Data includes contact information, demographic data, behavioral data, psychographic data, for the purpose to identity and understand target audience, to personalize marketing communications and offers, to measure the effectiveness of marketing campaign, to optimize marketing strategies and tactics and to comply with legal and regulatory requirement.
  • Compliance Data includes Personal Data we may collected on you for the purposes of complying with our legal obligations.
  • Recruitment Data such as previous employers, references by previous employers or colleagues, type of job held at other companies, previous or expected salaries, skills and qualifications obtained through education or experience. This Personal Data will help us make a decision on your suitability for employment and in case your application is for future vacancies the aforesaid Personal Data will help us to decide which department you may be most suitable in.

     

  1. Sensitive Personal Data (“SPD”)

SPD refers to the Personal Data that is particularly sensitive or private, such as religious or philosophical beliefs, private life, racial or ethnic origin, health and genetic data, which is likely to result in damage to the personal dignity of any natural person or damage to his or her personal or property safety once disclosed or illegally used. The meaning of SPD may differ in different jurisdictions according to applicable laws and regulations. The SPD that we may collect from you includes:

  • Personal Property Data includes payment information, coupons information, etc.
  • Personal Location Data includes tracking information, accommodation information, etc.

We may occasionally collect other types of SPD or Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, information about your health and genetic and biometric data). In some instances, this may also include information about criminal convictions and offences.

When and why do we process your Personal Data?

We only collect and process Personal Data to the extent necessary to carry out our services for the following purposes as described in this Privacy Policy, in accordance with the principles of lawfulness, legitimacy and necessity. We will fully inform you of the purposes and methods of processing Personal Data, and the types and retention period of the processed Personal Data within specific scenarios in appropriate manners. We may process Personal Data about you in various cases, such as for example:

  1. Basic functions
    Basic functions are functions that are set up to meet your fundamental purposes and most important needs for our services, including those necessary functions for reservations, payment services, after-sale and customer services and etc. To ensure the use of basic functions, we may collect, use and retain your following Personal Data. If you fail to provide or fail to give consent to the collection of such Personal Data, you will not be able to access our services relating to basic functions, and please stop using the relevant services immediately.
  • Reservations
    We provide booking services for our hotels, restaurants and other entertainment activities via our websites, mobile phone applications (including mini programs and official account) (collectively “Booking Platforms”). When using these Booking Platforms, you need to provide details such as the dates, types of services and essential information (for example number of rooms/tickets) for your booking, and we process your Personal Data including your name, email address, telephone number, city of residence, to complete the booking for you.
  • Payment
    After you submit your booking information, you may choose to pay by WeChat or bank transfer, provided by a third party.  When you use the services of a third-party payment institution (“Payment Institution”), your Financial Data, such as your bank account, passcode, amount of payment, will be collected by the Payment Institution. Your booking number and transaction amount information will be provided to the Payment Institution, so as to confirm your payment order and to complete the payment.
  • After-sale and customer services
    Our customer service hotline and after-sales function will use your booking information, your Personal Data and other necessary information, for the purpose of providing after-sale and customer services, including without limitation to, request of a refund or invoice, notice of your purchased items/services, change of booking dates for the services, delivery address, contact person/phone number, etc. Our customer service hotline may use your booking/order information and your identification information to verify your identity. 
  • Feedback services
    You can provide feedback and advice to our services through our mini programs. We may collect your telephone number, email address and your feedbacks.
  • Membership registration
    We provide membership services through mobile phone applications and mini programs. When you use these applications and mini programs to register as our membership, we may process your Personal Data, such as your name, date of birth and telephone number
  • Membership services
    Upon the enrollment of our membership, we may contact you via your telephone number, WeChat account regarding membership information and our promotion, including but not limited to, the status of your membership, important information about our services and offers updates.
  • Services improvement
    We may obtain other Personal Data that is reasonably necessary for providing services and to improve the quality of our services, booking and membership platforms and means of communication, including information you provide when contacting customer service, voluntary responses to our surveys and your Personal Data on the interactions with our affiliates, partners and other third parties. We may also correlate with the information you provide on our Booking Platforms and at properties to ensure a consistent service experience.

 

  1. Advance functions

Advance function is the function in addition to the basic functions to enhance your user experience and optimize the quality of our services. You have the choice of whether or not to authorize us to collect the following information related to advance function. If you refuse to authorize us or provide us with the information, you will not be able to experience the advance functions. Your use of the basic functions will not be affected.
 

  • Data tracking and profile
    When you use our websites, mobile applications (including mini programs and official accounts), we may collect information based on your behavior, preference and patterns to tailor our services and to enable us to provide you with privileges and special access on that basis. Such information includes your WeChat Union ID, open ID, business ID, your browsing history, and event history. 
  • Marketing services
    In our online or offline marketing activities, we may collect Personal Data including name, email address, telephone number, city of residence. You can choose whether or not to authorize us to collect it. If you refuse to provide it, it will not affect your use of the basic functions, but you will not be able to participate in the relevant marketing activities.
     
  1. Other cases

We may also process your Personal Data in the following cases, such as for example:

  • When you or your organization make an enquiry through our website, in person, over email or over the telephone, including but not limited to applying for a position with us;
  • When you attend an event we may organize, or sign up to receive communications from us; 
  • When a corporate entity engages us to provide services and you hold an office or an interest in or have certain relationships with that entity (e.g. as a director or employee); 
  • When you or your organization provide services to us, or otherwise offer to do so; 
  • When you or your organization provide us with feedback;
  • When we collect information based on your behavior, preferences, patterns and similar to tailor our services and to enable us to provide you with privileges and special access on that basis;
  • When we receive Personal Data such as Contact, Financial and Transaction Data from third party providers of technical, payment and delivery services.

In the event where we need to process your Personal Data for purposes other than those set out in this Privacy Policy, we will explain the necessity of the Personal Data processing and obtain consent in appropriate manner in accordance with the requirements of laws and regulations, except that no consent is required by the applicable laws and regulations.

 

How will we use your Personal Data?

We will use your Personal Data, for the following purposes (“Permitted Purposes”):

  • Where we need to perform the contract we are about to enter into or have entered into with you;
  • To provide you with the services or other similar services you may have requested, including online services, as instructed or requested by you or your organization;
  • To manage and administer your or your organization’s business relationship with us, including processing payments, accounting, billing, and collection or support services;
  • For compliance with our legal or tax obligations (such as anti-money laundering, regulatory or tax reporting); 
  • To analyze and improve our services and communications to you;
  • To process suggestions, recommendations, or complaints in relation to our services and products;
  • To communicate with you through the channels you have approved to keep you up to date on the latest developments, announcements, and other information about our services, products and technologies, as well as events we may organize;
  • To comply with court orders and exercise and/or defend our legal rights;
  • To review your application for an employment position with us.

Where you have expressly given us your consent, we may process your Personal Data also for the following purposes:

  • For customer surveys, marketing campaigns, market analysis, contests or other promotional activities or events; or
  • To collect information about your preferences to create a user profile to personalize and foster the quality of our communication and interaction with you (for example, by way of newsletter tracking). 

With regard to newsletters, legal updates, and other general communications, you will always have the option to opt out of receiving such communications at any time.

Information on our promotional offers

We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have consented to it or if you have requested information or purchased services from us or if you provided us with your details when you entered a competition or registered for a promotion and in each case, you have not opted out of receiving marketing communications.

Treatment of third-party marketing

We will always get your express opt-in consent before we share your Personal Data with any company outside the Melco Group for marketing purposes.

 

Legal grounds for processing

Depending on which of the above Permitted Purposes we use your Personal Data for, we may process your Personal Data on one or more of the following legal grounds provided for under applicable data protection legislation:

  • Where processing is necessary for the performance of a contract with you or your organization;
  • Where we need to comply with a legal or regulatory obligation;
  • Where it is necessary for our or our contractors’ (where applicable) legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
  • When we have your consent to do so, where you have expressly given this to us;
  • Other legal grounds under applicable data protection legislation.

How might we share your Personal Data?

We limit the access to Personal Data to those who require such access to perform their tasks and duties, and to third parties who have a legitimate purpose for accessing it. Whenever we permit a third party to access Personal Data, we will implement appropriate measures, retain control over and will use appropriate safeguards as required by the applicable laws to ensure the integrity and security of your Personal Data when engaging such service providers.

  1. Transferring to other group companies

We may provide or entrust the processing of your Personal Data to our affiliates within the Melco Group, domestically or abroad, to process Personal Data for the Permitted Purposes on our behalf and in accordance with our instructions only. 
 

  1. Transferring to third party service providers

We may transfer your Personal Data where we may instruct service providers outside the Melco Group, domestically or abroad, e.g. IT services or server providers, to process Personal Data for the Permitted Purposes on our behalf and in accordance with our instructions only.
In certain cases, this may also mean that your Personal Data may be transferred to locations outside Macau.

 

  1. Transferring to other group companies

We will otherwise transfer your Personal Data to third parties or disclose your Personal Data on other lawful grounds, when:

  • To comply with our legal and tax obligations, including where necessary to abide by law, regulation or contract, or to respond to a court order, administrative or judicial process, including, but not limited to, a subpoena, government audit or search warrant.
  • In response to lawful requests by public authorities (including for national security or law enforcement purposes).
  • As necessary to establish, exercise or defend against potential, threatened or actual litigation.
  • Where necessary to protect the vital interests of another person.
  • In connection with the sale, assignment or other transfer of all or part of our services.
  • You direct us or give us permission or separate consent to do so.

 

Transfers of Personal Data abroad

We are active across the world – this means that we may transfer your Personal Data abroad if required to do so for the Permitted Purposes. In certain cases, this may include transferring Personal Data to countries which do not offer the same level of protection as the laws of your country or Macau (such as for example the data protection legislation of Macau).
When making such transfers, we will ensure that they are subject to appropriate safeguards in accordance with the Macau Personal Data Protection Act (Law 8/2005) or other relevant data protection legislation, or that we otherwise comply with the requirements and standards under the Macau Personal Data Protection Act (Law 8/2005) and other applicable laws and regulations for transferring Personal Data abroad. Can you refuse to share your Personal Data with us?

In general, we receive your Personal Data where you provide this on a voluntary basis, and there will typically be no detrimental effect for you if you wish not to provide this or otherwise withhold your consent for it to be processed. However, there are certain cases where we will unfortunately be unable to act without receiving such Personal Data, for example where we need to carry out legally required compliance screening or require such Personal Data to process your instructions or orders, or otherwise to provide you with our online services or communications.
Where it is not possible for us to provide you with what you request without the relevant Personal Data, we will let you know accordingly.

How do we keep your Personal Data safe?

  1. The security measures we take to protect your Personal Data

In order to protect the security of your Personal Data, we will use security measures that comply with the relevant standards under the laws and the current level of technology to protect the Personal Data you provide to prevent the Personal Data from unauthorized access, leakage, tampering or loss.

  • We comply with industry standards and have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. 
  • In addition, we limit access to your Personal Data to those employees, agents, contractors, and other third parties who have a business need-to-know only. They will only process your Personal Data on our instructions and they are subject to a duty of confidentiality. 
  • We use trusted protection mechanisms to prevent malicious attacks on data.
  • We will conduct Personal Data security audits according to the applicable laws and regulations.

We have established a specialized management system to safeguard the security of Personal Data, to limit the scope of personnel accessing the information, to require the relevant persons to comply with confidentiality obligations, and to conduct audits as required. For system on the protection of Personal Data and specialized personnel:

  • We have established a department dedicated to Personal Data protection and set up specialized information security officers to promote and safeguard the security of Personal Data;
  • We will establish a data classification and hierarchy system to manage and regulate the storage and use of Personal Data;
  • We will organize training courses related to security and privacy protection to enhance employees' awareness of the importance of Personal Data security protection;
  • We will develop and organize an emergency response plan for Personal Data security incidents; and
  • We will take all reasonably practicable steps to ensure that no unrelated Personal Data is collected.

 

  1. Your active self-protection is also essential to ensure the security of your Personal Data

The Internet is not an absolutely safe environment and it is uncertain whether e-mail, instant messaging, social software, and other means of communicating with other users are encrypted or not. We strongly recommend that you do not send your Personal Data through such means and that you should set up complex passwords when using such tools.
If you have a password-protected accounts such as an e-mail account, we recommend that you do not share your password with others. We will not call or email you to ask for your password.

 

  1. Possible security risks and our legal responsibilities after you providing your Personal Data

The Internet environment is not 100% safe and we will endeavor to protect the security of any Personal Data you send us. If any breach of our physical, technical, or administrative safeguards results from unauthorized access to, disclosure of, alteration of, or destruction of information, which may lead to infringement of your legal rights and interests, we will take the appropriate legal actions. We will not be responsible for any losses resulting from unauthorized third party access to your Personal Data out of our control.

    We have put in place procedures to deal with any suspected Personal Data breach or security incidents and will notify you and any applicable regulator of a breach or incident in accordance with the applicable legal procedures.
     

Personal Data we receive from you about other people

Where you provide us with the Personal Data of other people, such as your employees, directors of your companies, or other persons you may have personal or professional dealings with, you must ensure that you are entitled to disclose that Personal Data to us and you acknowledge to us that you have obtained any consents from those people and any authorizations as may be required under any applicable laws to provide us with such Personal Data, without us being required to take any further steps to collect, use, and disclose that Personal Data in the manner described in this Privacy Policy.

 

How long do we keep your personal data for?

We delete your Personal Data once it is no longer reasonably necessary for us to keep it for the Permitted Purposes or, where we have relied on your consent to keep your Personal Data, once you withdraw your consent for us to do so, and we are not otherwise legally permitted or required to keep the Personal Data.
We endeavor to avoid collecting and processing Personal Data that is not relevant to our services. We will only retain your Personal Data as long as is necessary to achieve the purposes as stated in the Privacy Policy, and will cease to use the Personal Data and will delete or anonymize such Personal Data as soon as you have successfully applied for cancellation, except where legally mandatory retention of such Personal Data is applicable. We decide the storage period of Personal Data according to the following criteria, whichever is longer:

  • completion of transaction purposes related to you, maintenance of corresponding transaction and business records to respond to your possible enquiries or complaints;
  • the requirement of financial accounting records;
  • whether you consent to a longer storage period;
  • whether there are any other special provisions or agreements for storage periods.

After the storage period has elapsed, we will delete or anonymize your Personal Data as required by applicable laws.

Importantly, we will keep your Personal Data as necessary for the purposes of defending or making legal claims until the end of the period during which we may retain the Data and otherwise until the settlement of any such claims, as relevant.

We do not store your SPD or Special Categories of Personal Data about you on your mobile device, and we use security measures such as disabling keyboard caching, deactivating the clipboard on text segments, and encryption when transferring and storing your SPD or Special Categories of Personal Data about you.

What rights do you have?

Subject to certain circumstances under the applicable legislation, you have the right to:

  1. Request a copy of the Personal Data which we hold about you or in certain cases request us to transfer the Data we hold about you to another provider.
    You may access to and copy your Personal Data by contacting us (you can find our contact information in the “Get in touch” section) or through the methods described in each page and mini program (if applicable), unless otherwise regulated by the applicable laws.

     

  2. Have any inaccurate Data we hold about you corrected or supplemented.
    If you find that your Personal Data is inaccurate or incomplete, you can make request to correct and supplement your Personal Data through customer hotline or bring the relevant materials to us (you can find our contact information in the “Get in touch” section). We will verify your Personal Data and make corrections and supplements accordingly.

     

  3. Object or restrict our use of your Personal Data.

    You may request to delete your Personal Data in the following circumstances:
  • the purpose of processing has been achieved, cannot be achieved or the Personal Data processing is no longer necessary for the realization of the purpose of processing; 
  • the storage period has expired;
  • the consent to the processing of Personal Data has been withdrawn by you;
  • our Personal Data processing activities breaches our agreement with you;
  • our Personal Data processing activities violates the applicable laws and regulations.
    If we decide to respond to your deletion request, we will also promptly notify the entities that received your Personal Data from us and ask them to delete it, unless otherwise required by applicable laws or regulations, or otherwise those entities have been independently authorized by you. 

 

  1. Where we have relied on consent to process your Personal Data, to withdraw your consent or change the scope or your consent.
    If you intend to withdraw your consent to the processing of Personal Data or change the scope of your consent, please contact us (you can find our contact information in the “Get in touch” section) with valid identification documents and submit an application in accordance with the requirements, and we will respond to your request in a timely manner upon the receipt of the application.
  2. Responding to your request above.

To enable us to process your request, we may require that you provide us with proof of your identity, such as by providing us with a copy of a valid form of identification – this is to protect the Personal Data we hold from unauthorized access requests and comply with our security obligations. We will respond to your request within mandatory period according to applicable laws and regulations.
    We may charge you a reasonable administrative fee for any unreasonable or excessive requests we may receive, and for any additional copies of the Personal Data you may request.
     

Personal Data of Minors

When providing our services, we do not normally collect the Personal Data of children under the age of 14. If we do, we will require proper consent from a parent or legal guardian, and we will verify such consent through proper methods prescribed under applicable laws. In this regard, we may request for name and other information relating to the parent or legal guardian to the extent required to verify proper consent. If we learn that we have collected children's Personal Data without legal guardians’ consent, we will delete it from our systems.

Corrections, updates and complaints

Where any Personal Data you have provided us with has changed, or where you believe the Personal Data we hold is inaccurate, or where you wish to make a complaint regarding our handling of your Personal Data, please contact us (you can find our contact information in the “Get in touch” section).

We will promptly respond to your requests and complaints. In the event that you are unhappy with our response, you may submit a complaint to the relevant privacy regulator. We can provide details of the relevant privacy regulator upon request. 
In addition, please note that if you have certain relationships with us or a third party entity to which we provide services, you and/or the third party entity may have a contractual or legal obligation to notify us of any change within a prescribed time period. We cannot be responsible for any loss that may arise due to us having any inaccurate, incomplete, inauthentic or otherwise deficient Personal Data which you or a third party entity have provided to us.
